It served as the basis for the departmental RSDs.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Mechanical sweeping<\/strong> compulsory (not chemical alone).<\/li>\n\n\n\n<li><strong>Frequency<\/strong> historically <em>up to twice a year<\/em> depending on the department.<\/li>\n\n\n\n<li><strong>Chimney sweeping certificate<\/strong> handed over to the occupier.<\/li>\n<\/ul>\n\n\n\n<p>Replaced\/modernised at national level by the texts of 20 July 2023 where contradictions, but remains a <em>historical reference<\/em> and the basis for many RSDs.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"loi-1996\">\u2696\ufe0f Law no. 96-603 of 5 July 1996 (craft qualifications)<\/h3>\n\n\n\n<p>Establishes the principle that certain craft activities may only be carried out by <strong>qualified professionals<\/strong>.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Requires <strong>professional qualification<\/strong> for self-employed practice.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"decret-1998\">\ud83d\udc77 Decree no. 98-246 of 2 April 1998 (\u201cRaffarin\u201d)<\/h3>\n\n\n\n<p>Decree implementing the 1996 law: it <strong>list of regulated professions<\/strong> and specifies the qualifications required.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Trade of <strong>chimney sweep\/smoker<\/strong> (sweeping, installation and maintenance of flues and appliances).<\/li>\n\n\n\n<li>Qualification by <strong>diploma (CAP\/BEP\/title)<\/strong> or <strong>3 years' experience<\/strong> recognised.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"rsd-rsdt\">\ud83c\udfdb\ufe0f RSDT &amp; Departmental Health Regulations (RSD)<\/h3>\n\n\n\n<p>Each d\u00e9partement sets out its health and safety obligations (including chimney sweeping) in its RSD, historically based on the 1969 decree.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Minimum frequency<\/strong> and <strong>conditions<\/strong> sweeping (often mechanical, heating periods, etc.).<\/li>\n\n\n\n<li><strong>Obligations of the occupier<\/strong> (tenant\/owner).<\/li>\n<\/ul>\n\n\n\n<p>Since 01\/10\/2023, in the event of contradiction, national provisions take precedence. The RSD remains <em>complementary<\/em> when there is no conflict.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"pack-2023\">\ud83d\udd25 Decree no. 2023-641 &amp; Order of 20 July 2023 (current reference)<\/h3>\n\n\n\n<p>National text that <strong>modernises and unifies<\/strong> maintenance of combustion appliances and <strong>sweeping<\/strong> flues (wood, pellets, gas, oil).<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Specifies <strong>sweeping procedures<\/strong> and\u2019<strong>maintenance<\/strong>.<\/li>\n\n\n\n<li>Confirms the <strong>professional qualification<\/strong> intervening.<\/li>\n\n\n\n<li>Supervises <strong>documents to be submitted<\/strong> (including chimney sweeping certificate).<\/li>\n\n\n\n<li>Harmonises <strong>minimum frequencies<\/strong> depending on the equipment and use.<\/li>\n<\/ul>\n\n\n\n<p>Entry into force on <strong>1<sup>er<\/sup> October 2023<\/strong>.
